Terms of Service

These terms cover your use of Pydak, a CRM for contractors operated by Tim DiSabatino based in Monterey, California. By creating an account or using the service, you agree to what's below. It's written in plain language on purpose. If anything is unclear, email hello@pydak.com and I'll respond.
Who runs Pydak
Pydak is run by Tim DiSabatino in Monterey, California, USA. When these terms say "we" or "I," that's the same person.
Who can use Pydak
You need to be at least 18 years old and able to enter into a binding contract. If you're signing up on behalf of a business, you're confirming you have the authority to accept these terms for it.
Using your account
You need an account to use Pydak. You're responsible for keeping your password safe and for what happens under your account. Tell me promptly at hello@pydak.com if you think someone else has gained access.
Acceptable use
Pydak is for running your own contracting business and managing your own customer relationships. Please don't:
- Break the law with it or use it to store data you have no right to hold.
- Upload other people's data you weren't given permission to collect.
- Send spam or unsolicited bulk messages using contact data in the system.
- Try to break, overload, reverse-engineer, or gain unauthorized access to the service or other tenants' data.
- Resell or rent access to the service without my written permission.
If an account is being used this way, I may suspend it to protect the service and other users.
Early access and availability
Pydak is in early access. It works and I use it seriously, but it's still young. Features change and things occasionally break. There is currently no service-level agreement (SLA) and no uptime guarantee during this period. I aim to keep it running and to fix problems quickly, but you shouldn't rely on it as your only copy of anything critical. Keep your own backups of data that matters to you.
The service is provided "as is," without warranties of any kind, to the extent the law allows.
Your data belongs to you
The contact and job data you put into Pydak is yours. I don't sell it, and I don't use it to build products for anyone else.
To actually run the service, I need your permission to handle that data. By using Pydak, you grant me a limited, non-exclusive license to store, process, back up, and display your data for the sole purpose of operating the service, supporting you, and keeping it secure. That permission ends when you delete the data or close your account, apart from backup copies that expire on their normal schedule.
You can ask for an export or deletion of your data at any time by emailing hello@pydak.com. The Privacy Policy explains what's collected and how it's handled.
What you're responsible for
You're responsible for the data you put into Pydak, including having the right to collect and store it. If someone brings a claim against me because of data you uploaded or the way you used the service, you agree to cover the reasonable costs of defending and resolving it. This doesn't apply where the claim comes from my own negligence or my own failure to do something I said I'd do.
Cost during early access
Pydak is free during early access and there's no payment processing yet. If and when paid plans arrive, I'll give you notice before anything changes, and early-access users will be locked in at the launch price for as long as they keep their account.
Limitation of liability
To the maximum extent allowed by law, Pydak and its operator won't be liable for indirect, incidental, or consequential damages including lost profits, lost data, or lost business arising from your use of (or inability to use) the service.
Total liability for any claim is limited to the greater of one hundred US dollars or the amount you paid in the twelve months before the claim.
Ending your account
You can stop using Pydak and close your account whenever you like. Just email me. I may suspend or close accounts that violate these terms or that put the service or other users at risk. If I ever wind down the service, I'll give you reasonable notice and a chance to export your data first.
Changes to these terms
As Pydak grows, these terms may need updating. When I make a meaningful change, I'll update the date at the top and, for significant changes, let account holders know by email. Continuing to use the service after a change means you accept the updated terms.
Governing law
These terms are governed by the laws of the State of California, USA, without regard to its conflict-of-laws rules. Any dispute will be handled in the state or federal courts located in Monterey County, California.
The remaining legal bits
If one part doesn't hold up. If any part of these terms turns out to be unenforceable, the rest stays in effect.
The whole agreement. These terms, together with the Privacy Policy, make up the entire agreement between us about your use of Pydak, and they replace anything discussed beforehand.
Transfers. You can't transfer your account or your rights under these terms to anyone else without my written permission. I may transfer mine if Pydak is ever sold or reorganized, and I'll let you know if that happens.
If I don't act right away. Not acting on a violation doesn't mean I've given up the right to act on it later.
